‘Ex-servicemen entitled to improved pension’

Chandigarh, May 26 In a judgment that can benefit a large number of ex-servicemen, specially the Personnel Below Officer Ranks (PBOR) in the armed forces, the Punjab and Haryana High Court has held that the ex-servicemen are entitled to improved pensionary benefits from January 1, 1996, the day the recommedations of the Fifth Central Pay Commission were enforced.

The order was pronounced by a Division Bench comprising Justice Hemant Gupta and Justice Mohinder Pal.

More than 65 writ petitions were filed by Bhim Sen Sehgal, the Chairman of All India Ex-Servicemen Welfare Association, challenging for arbitrarily notifying the date as January 1, 2006 for the implementation of the improved pensionary benefits.

The benefits were actually to be provided with effect from January 1, 1996.

The lower rank ex-soldiers were deprived of arrears which were due to them from January 1, 1996, the petitioners alleged.

The petitioners held that the Ministry of Defence had notified the implementation of the recommendations of the pay panel relating to the pensionary benefits of the Commissioned Officers and the PBORs with effect from January 1996.

However, it was revealed that the PBORs were not at all benefitted by the recommendations, whereas the commissioned officers and the honorary commissioned officers were benefitted to a large extent and they were given a huge amount of arrears from January 1, 1996 onward whereas the PBORs were left dry.

Aggrieved at the discrimination, the ex-servicemen moved the High Court which today allowed all the petitions.

Dear Sir, It is not understand that as to why the post 2006 pensioners has more service and senior in rank drawing lesser pension than pre 2006 pensioners who has lesser length of service and rank. It is came to understand that this anomaly has rectified and MOD has issued notification but so far this has not been implemented.How long we have to wait for the fruitful result

Dear Sir, Government is not implementing 70% pension to pbor post 2006 retired even after PM's declaration for 70% pension for pbor. It is very clear that our defence chiefs will never take any action and it seems that they are not even interested to put up this case to govt of India for the implementation and is resulting for demoralise our soldiers. One rank one pension must be given at the earliest as per 6th pay commission and recommended/approved by the Central Govt Since the new pay of JCO 9300 to 34800/-As per old rate of pension Ie 50% become 17400 basic pension.

Hello Sir, I am not understand that why Govt making so much different between the officer and PBOR.In every case Govt is giving right to officer power and benefits.even Govt thing that officers always right and do truly/correct but PBOR not doing right thing.So looking to this Govt always listen to only officer even PBOR's carrier,So i want Govt must think about the PBOR also as PBORs are working in the defense or defense officer are getting their per motion on the work done by the PBOR.I want PBOR's benefits Must be give with the due respect at the earliest Even 70% pension also pending.EX-ServiceMen and servicemen are giving their blood to Nation .Officer always demorlising PBOR in all the respect. It is not understood why the Govt. is not implementing the declaration of 70 % pension to Ex-Servicemen. Govt. had made it very clear that 70% pension would be given in the very beginning of 2009 but still it is not implemented. Ganesh Kumar

SIr, There is a very cleaver tricks used with PBOR 70% pension weightage along with ONE RANK ONE PENSION issue and the circular 430 was issued on ONE RANK ONE PENSION please compare the jawans retired and retiring after 01.01.06 their pension is less than the OROP please don't delay the issue pertaining to improvement of pension post 2006 even after PM's declaration of 70% pension for PBOR, there is no action has been taken on ground. All retiring and retired service personnel w.e.f 01.01.06 are eagrely waiting for any written reply from MOD. THE DELAY WILL BE DEMORALISED TO THE JAWANS WHO ARE STILL IN SERVICE.

One more occasion to expect the declaration of 70% pension to the PBORs who retired after Jan 06.Even a public and statutary promise by PM and FM has not been implemented till now and it shows the true strength of our leadership.Once they donot care for armed force personnel what about thier commitment for civilians.We certainly deserve accountable leadership.

Sir,The four core issues which were put forward for high level anomalies committee, all the issues have been implemented except the 70%pension for PBOR. Sir why this much of delay when it comes to the issues of PBOR even when the PM has agreed upon the pension issue and cabinet has approved in letter and spirit.

SIr, the imporved VIth pay commission recommendations in respect of Lt Col and Lt Gen has been implemented practicaly. They already has got their arrear. what i set forth to narrate here is not restricted to my personal case; but applicable to all those who fall in the category. the woes of JCOs usually fall on deaf years. I am retd AF JWO(gp II) My pension was fixed 2221/- wef 1/1/2006 this was increased to 2257/-in 2006; same time pension of a SGT Gp I was increased fm 2185/- to 2285 making it higher than a JCO.i.e a NCO is placed higher than a Junior Commissioned Officer. Is there any justification to lower the status of a JCO than an NCO. Why this factor was not taken into consideration while enhancing pension (PBOR)effective 1/1/2006. Why treat a JCO so insultingly; it is still not too late to rectify this gross injustice. will the authorities who can take decision look into this grievance and give desrving rights to this category of Armed Forces, who are without Godfathers and who deserve to be treated with bit more respect and sympathy. I sincerely hope that something will be done to rectify the anomaly explained above. Thanks

Dear sukumaran,There is no justification in you demand. It is not only the pension but your pay was also less than the pay of gp I Sgt. Then why you didnot crib when you were in service. You know the reasons why you were paid less. The people reading your cribbing not only know about jco and nco they also know about the different groups, qualifications, working conditions etc. so no point cribbing here thinking that others are ignorant of this. But the fact is that everyone over here knows the fact. So need not to create drama to draw sympathy.
