A single-judge bench of Justice K M Thaker passed the order in this regard while acting on a petition moved by the accused, identified as Mohsin Abdul Kadar Pathan (22), a resident of Danilimda area of Ahmedabad.
The next hearing in the matter has been kept for February 11.
Pathan’s lawyer Mukul Sinha said his client had married a Hindu girl in October last year after they fell in love during college days. However, the girl’s father wrote to the Home Minister stating his daughter had got married to a Muslim and registered his opposition to any possible application by her to convert to Islam under the provisions of the Freedom of Religion Act. Sinha said that at the time of marriage, the girl had given an affidavit to the Maulvi who solemnised their marriage declaring she wanted to get married as per Islamic rituals.
“The application was transferred to the Ahmedabad collector, who ordered the police to register an offence under the provisions of the Freedom of Religion Act. Accordingly, the Karanj police booked four persons — Pathan, the Maulvi who solemnised the marriage, and two other witnesses,” said Sinha.
While the two witnesses and the Maulvi have been arrested, Pathan had been evading arrest and was able to move his petition seeking that criminal proceedings against him be quashed.
“The FIR itself is bogus and there is no case of conversion against Pathan. We have also argued that following the marriage, the couple is even having a four-month-old daughter now,” Sinha said.
The High Court has also issued a notice to the state government.

It is established from the signed affidavit before the Maulavi that the Hindu girl was in love with Mohsin Abdul Kadar Pathan. Could it be that under the influence of immaturity and ignorance about the outside world, the poor girl thought that she was in love? Her parents seemed naturally agitated; but they are also to be blamed for not imparting knowledge and pride about their religion to their daughter. Pathan on the other hand is full of pride for Islam. Even if it could be argued that he really loved the girl, it must be said that he loved Islam more than the girl. Did he spare a thought for the girl%u2019s parents%u2019 love for their religion? Think as to what the situation would be for any Muslim girl wanting to marry a Hindu boy according to the Hindu rites! Why are the upper and lower middle class Hindus going astray? Do they hate being Hindus? Why do they celebrate Christmas, New Year Day and St. Valentine%u2019s Day? Our Muslim neighbours seem to be contented just with their Eids!
No muslim girl marry to Hindu boys, being fanatic, as compare to Hindu women, if at all Muslim kill the girl or her husband. A Hindu Gandu can eat Beef where as a Muslim will kill a person who make them to eat Pork or Zatka meat.
Why a person, whether this religion OR that religion, whether boy or girl, has to change his/her religion ? If there is TRUE LOVE he or she should not insist or make the other person to change/convert to other religion. WBy can't they both convert themselves to a third religion say Christianity OR Budhism ? Have anyone heard a Christian getting converted to Islam OR a Muslim converted to Christianity ? NONE

It contradicts the fact that the girl had given an affidavit to the Maulvi who had solemnised their marriage declaring she wanted to get married as per Islamic rituals. Can a Hindu be married according to the Islamic rituals and yet remain a Hindu? What other criterion does the lawyer need for the conversion to be certified? According to the tenets of the Hinduism, the girl isn't Hindu any more-four month pregnant or not! The problem for the nationalist Hindu Community is, if Mohsin Abdul Kadar Pathan were to be indeed in love with the Hindu girl; then why didn%u2019t he solemnise the marriage according to the Hindu rites? Where was the necessity for the girl%u2019s affidavit before the Maulavi? In the current atmosphere of rape unrest, it would be advisable to maintain harmony by refraining from misadventures of love-jehad.
No parent will be happy to accept such marriage.However the law provides for the right to choose,so going to police is of no use.The action of the Govt official acting against law is questionable.
