In the case of alleged gangrape at Sandwa in Tosham, registered on September 30, the ATR reads, “The girl alleged that while she was going towards the house of her grandmother on September 29, three unknown youngsters came... forcibly gagged her and put her in the jeep. Out of three, one forcibly raped her. Her statement... was recorded before the judicial magistrate on October 1, wherein she stated that on September 29, when she was going through the street, three boys came and asked her to follow them into an unoccupied house. While one accused, Manoj, stood guard... the other two, Rakesh and Tony, raped her for about an hour...During the course of investigation, mobile call details of the accused as well as prosecutrix were obtained, which clearly reveal that the accused were known to the prosecutrix. They even had a conversation with each other a couple of hours before the incident... .”
In the case registered in Rohtak on October 2, the Action Taken Report said the victim “had turned back on her assertions and stated that she did not want any action and also she and her mother declined to get medical examination done”.
In the case of Dabra, where a 16-year-old was allegedly gangraped, the ATR does not mention the alleged MMS. Regarding the alleged gangrape of a 30-year-old woman, the ATR mentions that the police recorded the victim’s statement thrice, and each time a different section was added to the FIR.




The Police in India are known to protect the high and mighty.They easily pick up poor and weak and implicate them in false cases.For the ordinary people it is very difficult even to lodge an FIR. Bansi Lal was the only CM in Haryana who was able to discipline Jats in Haryana. That time there was some fear of police.Others are all incompetent. Unless police start taking proper action against such defaulters and judiciary takes a strong view of such incidents ,these incidents are not going to stop. The abrupt decline in social standards needs to be arrested by giving exemplary punishment to the defaulters. But with corrupt machinery which works to serve only the interests of dominant castes this can be hardly expected.
Supreme court or better the government should appoint a three member senior judges directly under the control of chief Justice and its support staff to probe, to counter verify police and local authorities, to probe whether any nexus of power, communal etc was invloved and make sure justice - life sentence or hanging to be given to culprits within 3 months. If the UPA government does not act , then supreme court should act immediately. Well we cannot trust our Parliament, with BJP never letting it function, the main objective of members in every session is to defend or pull down the government. They have forgotten India and its people. Shame on our elected members.
The benefit of doubt should be with the rape victim. So called Incoherence in victim's statements is expected due to a number of internal and external pressures. Often police personnel are insensitive, uncultured and politically pressured while questioning or recording their statements. In Indian socir=eties, there should be even more sensitivity demonstrated necause the concept of a "woman's honor" is culturally sanctified to the extent that it infrings into women's welfare considerations.
Indian police , judiciary should learn from western countries how to handle rape victims emotionally and scientifically. Just following some nonsense rules would only tramutizse the victims. The government of India should start the reforms immediately and make sure all states follow nationally. This is a national problem and not an state subject.
