Insurance policy is un-Islamic: Deoband

Agencies

Posted: May 14, 2010 at 1513 hrs IST

Lucknow After its fatwa that working in banks is un-Islamic, the Darul Uloom Deoband has now declared that opting for an insurance policy too went against the tenets of Islam.

The "insurance policy is unlawful as it is based on interest and gambling," claimed the fatwa issued by the country's largest Islamic seminary.

The edict issued by Darul Ifta department of Darul Uloom seminary was in response to a query whether it is lawful to take an insurance policy in the light of the Sharia.

Millions of Muslims in India opt for insurance policies which is a contract that pledges payment of an amount to a person assured or his nominee against losses or perils.

"The clerics who issue fatwas should also explain the context in which it is being issued to avoid any confusion," Maulana Afroz Mujtaba, a Delhi-based cleric, said.

Meanwhile, leading Islamic body Jamiat Ulema-e-Hind's spokesman Abdul Hameed Nomani said that fatwas should not be generalised and they should be seen in the context in which they have been issued.

"People must read between the lines and not generalise the fatwas," Nomani said.

Earlier, Darul Uloom had declared the job of writing and calculating interest based work in banks and insurance companies as unlawful. The fatwa was in response to whether Muslims can do job in bank or insurance company.

The recent fatwas have drawn flak from many clerics and progressive leaders.

The seminary had also decreed that it was illegal according to the Sharia or Islamic law for a woman to work and for a family to accept a woman's earnings.

However, clerics at the largest Sunni Muslim seminary said the decree was based on the fact that the Sharia prohibited proximity of men and women in the workplace.

deoband - needs a legal band and ban by laxman on 15 May 2010

are they trying to create some mess out of creating these fatwas. why these stupids want to see everything through microscope. then why arab countries are selling gold, oil & developing tourism to attract western people? what a shame on these fellows. also media should not entertain these news and should sensor such news before they grow up and create a havoc by our great :) political leaders

Carry on with the analysis. Leave the action part to the people. Please. by Jayadevan on 15 May 2010

The DUD is correct, insurance(life term policies) does amount to gambling - we are betting on the possibility of a person dying on a date before the more seasoned gambler, backed by a team of actuarians reckons likely for death. But so does a farmer sowing his seeds gamble, so do a husband and wife having children in the hope that they will grow up well. Their analysis being correct does not make providing for your family in case of untimely death sinful, does it? Religion is an instrument, however crude, that man uses to explore his relationship with the rest of creation. The theologist's job is to find out and define what has been laid down and what should be done. They will not necessarily be correct, but their job is to go on nevertheless. Application of these insights in life is not, however, something that they can insist upon. This is for the common man to decide, with his common sense and capacity to tell the theologists where they get off, well before they turn theocrats.

There is no limit to their stupidity by jas on 14 May 2010

This world would be such a boring place without these strangely deranged indivituals of Darul Uloom Deoband and VHP. Allah and Bhagwan are two very funny guys who are also very kind to provide humanity with these jokers.

what a joke !!! These Cleric should not live in air conditioned houses . leave in tents , do not use motor vehicles, have intercourse with goats and camels and trade women like cattles like their ancestors did in ancient arabia.

your language is inappropriate by afroz on 15 May 2010

Shyam, Your coemments are disrespectful. Islam stopped the trading of women and prohibits it. Please know about Islam from a proper source before you comment.

PROHIBITED IN ISLAM by NIRANJAN on 15 May 2010

THERE ARE MANY THINGS PROHIBITED IN ISLAM OR FOR THAT MATTER OTHER RELIGIONS. DOES IT MEAN THAT THOSE RULES ARE NOT VIOLATED? WOULD YOU SAY THAT MUSLIMS DO NOT DRINK LIQUOR? OR INDULGE IN EXTRA MARITAL AFFAIRS? OR COMMIT ADULTERY? THERE ARE ALWAYS EXCEPTIONS TO ANY RULE AND LAW. YOU CAN'T SAY THAT BECAUSE ISLAM PROHIBITS SOMETHING THAT IT IS NOT DONE BY ANY MUSLIM!

Fatwas on insurance by Arun Kumar on 14 May 2010

If these obscurantist clerics have their way, ordinary muslim will remain imprisoned in the 7th century, whilst the world moves on. These guys should use their head, if they have one, otherwise they will lose complete following. Edicts shold be intelligently applied and issued keeping in mind the progress of humanity in general.

Deoband needs to be ignored. We have better things to read.

let it be by s chadha on 14 May 2010

why should the media high light such innanities? are they important edicts of law or supreme court judgments that they should be highlighted/ discussed and commented about ? it was goebbels who had sid that repeated lie can become a truth same is i feelis with high lighting / giving importanceto such obduracies they only give, i feel importance to such men / things which only seems to make them more self opiniated. it also results in chasms in the society the obdurate muslim clergy wants to divide the communities by harping on the differencies of this community to all others to keep them backward and themselves as their saviours .and what is the big deal? if someone does not like the insurance let him not take whether it is due his personal choice or under influence of such nudgings what difference it makes so media should stop focussing on these trivial things as if they are marvels of literature or nuggets of wisdom for humanity they are mererantings --- let them be

Stop coverage to this kind of babble by Chandramohanarao on 14 May 2010

It is high time Print and Electronic media stops coverage to such elements like Clerics, Khaps, babas, priests et al. As long as they get coverage they indulge in such babble. When not much importance is being given to these so called defenders of scriptures and customs by followers of religion , we see no point in press and media giving them prime slots. If these elements are ignored for a few days they stop blabbering on what they seem to know but do not actually know. This kind of prattling by pseudo religious leaders is driving many theists into agnostics or raw atheists. It is time IE stops coverage to these elements and takes a lead by publishing in bold advising other media houses also follw suit.

Insurance policy is unIslamic - Deoband by john jacobs on 14 May 2010

Who is running this nation,Deoband or the Govt of India? Of late a stream of fatwas and demands have been issued by the Deoband;on the Islamic perception of married Muslim women being sole bread winners for the family, working in proximity with men and the age old principles developed on the working of insurance and banking industries not being in accordance with Islamic religious beliefs. The reticence of the govt in the face of such extremist and narrow points of view only lends encouragement to the notion of a two nation theory, long espoused by Islamic adherents,in effect giving in to the creation of a divided nation once more on religious grounds. It is about time the govt had stamped its authority against such strident anti national calls and show Deoband of its rightful place, which is the Masjid and not the Parliament House.Staying on in power with the help of a client class of supplicant voters is no substitution for an undivided India.

Islamic Fatwas by Chirtarun on 14 May 2010

A short message to Deoband: India is not an Islamic state and will never be; so, move to an Islamic state to fulfill your Islamic ideals.

Deoband's Fatwa on Insurance by Padmini Narayanan on 14 May 2010

Just as karma theory has been blocking Hindu mindset, the word %u201Cinterest%u201D has been blocking conservative mullahs minds. Interest is a factor of production and it has two components namely (a) reward for a factor of production and (b) compensation for inflation. No one will be a fool to lend Rs 100 today and take back Rs 100 after 2 -3 years with the current inflation. What should be prohibited is usury and not interest. Painting interest and usury with the same brush is absolute non sense. Islamic Banking and shariah compliant banking products are a big humbug to circumvent interest. An alternative to insurance (for example life insurance) is to leave one%u2019s dependents to the mercy of the society and is an irresponsible act. It is high time the Islamic community stands up and ask its ill read mullahs from announcing fatwas.

Simply great by Ramesh on 14 May 2010

One hopes that the usual "one section of Hindus" will not be held responsible decades later for backwardness that Muslims suffer from obeying such Fatwas. One hopes that the media persons will take note of how people choose to keep themselves 'backward' and start blaming another section of Hindus for all their imaginary grievances, delusions and hallucinations.
