Preeti Jain 'rape' case: Madhur Bhandarkar gets relief after 9 years

New Delhi The Supreme Court today quashed the ongoing criminal proceedings of Bollywood film director Madhur Bhandarkar on allegations of rape levelled by actress Preeti Jain.

A bench of justices H L Dattu and C K Prasad passed the order noting that Jain did not want to pursue the case against Bhandarkar and the Mumbai police had earlier given a clean chit to the film director.

The bench set aside the order of the Bombay High Court which had confirmed the magisterial court's decision to continue with Bhandarkar's prosecution.

Bhandarkar had challenged the high court's order, which had asked him earlier this year to face the trial in the case.

The actress had lodged a complaint with the Versova police in July 2004 alleging that Bhandarkar had raped her 16 times between 1999 and 2004 on the pretext of casting her as actress in his films.

She alleged Bhandarkar promised to marry her and to cast her in his films, but he went back on his promises later.

A Mumbai trial court last year had found substance in Jain's complaint and had asked the national award-winning filmmaker to face the trial.

Bhandarkar had challenged the lower court's order before the high court which too had rejected his plea.

In September 2011, the police had filed a report stating that the case against Bhandarkar was false.

The trial court, however, had rejected the police report which had said the case was 'maliciously false.' The court had held that there was prima facie case against Bhandarkar.

Cheating is not rape. Females shoudl not be cry babies. Females want rights but without liabilities or responsibilities .... what a way to go ...

Any small child also will say , it is not rape, but our Great Law makers failed to understand the same, result today we witness every day the cry for Rape is increasing by misuse the loophole in the Rape law the physical relation was under consent or without consent. In the Judgment though Supreme court had Quashed the FIR, but no where they had mentioned any Punishment for those who file such false/fabricated FIR. It is the time Supreme court must start punish such people for making False and Fabricated FIR to give a messages that "Legal Terrorism" also a crime in this country, as government forget about to propose any punishment, they have not ready to even give a small provision of warning to such people, result more and more false/fabricated FIR getting registered every day in and out.

It is shocking to note that Preeti Jain who valiently took on Mr Bhandarkar does not want to persue the case. It is more shocking to see that justice to the society is denied on trivial grounds. Is it due to the money power of Bhandarkar ?
