Taj corridor case: Mayawati not to face trial, HC dismisses PILs

Lucknow In a major relief for former Uttar Pradesh chief minister and BSP supremo Mayawati, the Allahabad High Court today dismissed petitions against her in the Taj Corridor case.

The Lucknow Bench of the court also dismissed the petitions against her Cabinet colleague Naseemuddin Siddiqui.

Passing the order, the Bench comprising Justices Imtiyaz Murtaza and Ashwani Kumar Singh said all petitions were devoid of merit and were accordingly being dismissed.

BSP leader and Mayawati's counsel Satish Chandra Mishra termed the petitions filed in the case as "politically motivated" and pursued with "malafide intention".

"There are no offences against Mayawati in the Taj Corridor case," he told reporters here after the court delivered a 74-page verdict.

The Bench had on September 12 reserved its judgement on the PILs seeking direction for initiation of proceedings of criminal case against Mayawati and Siddiqui.

The special CBI court had in June 2007 dropped proceedings against Mayawati and Siddiqui for lack of prosecution sanction, which was not granted by the then Governor.

After this, three PILs were filed in 2009 challenging the decision of the CBI court. Later three more PILs were filed in this connection.

I don't understand this judgement? Is it based on merit or on technical grounds. If technical, there could not be worst judicial tragedy.

The immunity from prosecution is being misconstrued by everyone in our country. The immunity from prosecution was made to protect the public servants from legal action performing their office duties. May be everyone thinks corruption is official duty in India. Its shocking when courts too say the same.

Why doesn't the law has single set of standards for every citizen of india? When politicians like Mayawati is under scanner why the approval from Governor is required? If she has done corruption during her position as chief minister why shouldn't she be probed and why does the investigation agencies require approval from governor? It is taxpayer's money not the government's or the governor's. Why does the political class always privileged even in the case of corruption?
