“The medical report said Pinki is a male and the charges against the athlete have been established,” Additional Public Prosecutor Shantamay Basu said after submitting the medical report prepared by the SSKM Hospital to a court in Barasat. Basu said the report confirmed allegation of physical assault against Pinki.
Pinki was arrested on June 14 after being accused of rape and torture by former live-in partner, Anamika Acharya. A month later, Pinki was released on bail as gender determination test conducted by a private nursing home and that at Barasat General Hospital remained inconclusive. Pinki then rejoined work as TTE for the Eastern Railway after the suspension was revoked.
In the chargesheet filed by the police on Monday, Pinki has been charged under Sections 376 (rape), 506 (criminal intimidation), 420 (cheating), 417, 325 (grievous hurt) and 493 (bigamy) of the IPC.
Speaking to The Indian Express, the former middle-distance runner, who won the 4x400 m relay gold at 2006 Doha Asian Games, termed it a “huge conspiracy”. ‘
“A huge conspiracy has been hatched against me by the police. I am shocked and don’t know what to do. They are trying to force me to commit suicide. After medical tests, the board concluded that I am not capable of committing rape. I had some symptoms of excess male hormones which is because of the drugs I had taken during my athletics career. I am yet to receive any official notification from the police or court and learned about the latest development from the media. I am sure that the medical reports have been tampered with, and the police put forward their theory in the chargesheet,” Pinki said.
Pinki added that the court was yet to reply to the request for a copy of the medical report sought in September.
Acharya said she was happy with the outcome of the medical report. “There were many who questioned my character when I complained of being raped by Pinki. I am happy today and firmly believe that the other charges would be established soon. I have lived with him for three years and I know him like no one else,” Acharya said.
Asked if she would claim damages, Acharya said: “Whatever damage he has done to my life and character, it can never be compensated. Now, more than anything else, I want to see him punished.”
Medical Board member differs
A member of the medical board has differed with the chargesheet filed by the police. “After the chromosomal test we concluded that Pinki has a 46 XYY karyotype which indicates that the athlete has sexual development disorder. It’s an abnormal karyotype and Pinki can’t be called a male,” said one of the board members.
Medals to stay with Pinki
The medals and awards that Pinki has won in national and international events will not be taken away for now. “The Athletics Federation of India will act only after the final verdict. The case is sub-judice and Pinki is fighting a legal battle. The athlete is not guilty until charges are proven in the court of law,” West Bengal Athletics Association secretary Kamal Moitra said.

Now just because of some half-brained allegations of some policemen, who seem to enjoy torturing Pinki, the uninformed public is making all sorts of comments on her. IS IT PINKI'S FAULT THAT HER BODY IS DIFFERENT FROM A NORMAL WOMAN'S? The answer is NO. She has certain male characteristics, but that DOES NOT MAKE HER A MAN. Medical Science has advanced tremendously in the understanding of Gender Determination and Classification. Pinki has participated in International Sporting Events, and has cleared Gender Tests, because there are International Standards set on the base of Scientific Research. There are many International Athletes who have the same characteristics (ex. Martina Navratilova, Caster Semenya of South Africa), and who qualify for Female Events.
