Noida A week after six students of a premier Noida school were injured when their car crashed into a truck, the father of one of the injured students is planning civil action against the father of the 17-year-old boy who was driving the Volkswagen Polo.

The students were injured when their car was on the DND Flyway slip road, on the turn towards Sector-15A, on November 12. The car crashed into a truck at 9.50 pm.

Shiv Bhargava (18), who was on the passenger seat, was seriously injured. Two other boys, who were on the rear seat, also suffered injuries. The driver of the car and two girls on the rear seat had minor injuries.

Shiv’s family said he had extensive injuries on his face and eyes, and is still at Kailash Hospital.

The family has alleged that minutes after the accident, the father of the boy who was driving the car reached the spot and took him away. He left the other injured students at the spot, the family said.

BJP’s Noida MLA Mahesh Sharma, who was said to have been passing through the area at 10.15 pm, rushed the other injured students to Kailash Hospital.

A representative of Sharma said: “The three injured boys were by the roadside in the severely damaged car. Maheshji was on his way home. Seeing that one of them was seriously injured, he took them to Kailash Hospital. Lives could have been lost had they not received medical attention in time.”

Based on Shiv’s father’s complaint, police filed an FIR, which said the other students had asked the boy driving the Polo to slow down, but he did not pay heed. “He did not have a licence,” the FIR said. A case was registered against the underage student, but police said juvenile justice norms prevent them from arresting the 17-year-old.

Shiv’s father, Aseem Bhargava, said he is looking at legal options against the boy’s father.

“While no criminal case can be made out, we are looking to file a civil suit so that compensation charges are borne. The driver was underage. Further, the father abandoned the injured on the road,” said Vibyha Makhija, an advocate and a relative of the victim.

With severe damage to his face and eyes, Shiv underwent a six-hour reconstruction surgery on Monday. “There was damage to his eyes because of glass shards. Facial bones were also damaged,” a doctor said.
