Ex-UP chief secy gets 3 yrs RI in Noida land scam case

Ghaziabad A special CBI court in Ghaziabad on Tuesday sentenced former chief secretary of Uttar Pradesh and 1971 batch IAS officer Neera Yadav to three years of rigorous imprisonment and a fine of Rs 1 lakh in two separate cases related to Noida land scam.

Along with Yadav, Rajiv Kumar, who is now Principal Secretary in the UP government, has also been convicted and given the same sentence in one of the cases.

Yadav has been sentenced for “taking pecuniary advantage by entering into a criminal conspiracy with Rajiv Kumar”. The impropriety allegedly took place between 1994 and 1995 when Yadav was the CEO and Chairperson of Noida Authority. Kumar was then the deputy CEO.

According to the prosecution in the case “both officers abused their position as public servants in the allotment of residential plot no.27 in sector 14 A, Noida, to Rajiv Kumar by converting the land use which was earmarked for a guest house and also increased the area of the plot without proper approval.”

Neera Yadav was earlier convicted by a CBI court in December 2010 for irregularities in allotment of plots and also for changing the land use in plots to her and her daughters’ names. She was awarded a four-year jail term but was later granted bail by the Allahabad High Court.

According to the CBI case, when Yadav headed the Noida Authority, she alloted to herself the plot no B-002g in sector 32, Noida, and then got it converted to plot number 26 in sector 14A. This despite the fact that the application submitted by her was incomplete in many ways and was submitted after the closing date of the scheme.

The CBI case says that after taking possession of the Sector 14A plot, she also managed to increase the area of the plot from 450 sq m to 562.5 sq m. While the Noida Authority rules say that only one plot of land could be allotted to one family, Yadav also got two plots allotted for her two daughters. Both Yadav and Kumar were released by the CBI court on the submission of personal bonds of Rs 1 lakh each, and have 30 days to file an appeal, as per CrPC.
